Legality of the use of video surveillance systems in transport
According to Russian Government Decree No. 969, which was issued at the end of September 2016, passenger transport, starting with minibuses, and fuel trucks are equipped with certified video surveillance equipment. Owners of personal vehicles are not required to install recorders or cameras.
There are two more regulations governing the use of surveillance and video recording. These:- The Law on Transport Security - No. 16-FZ of 2007.
- Government Resolution No. 1640 of 2020.
Due to the rapid development of smart technologies, the legislative framework is constantly being improved. The control of compliance of cameras and video recorders with the requirements of regulatory acts is entrusted to the system of the Ministry of Internal Affairs of the Russian Federation. In the permit document for the installed equipment, it is necessary to fix the name of the model, and not just specify the type of equipment.
There are current restrictions in the use of video surveillance related to the security of citizens' personal data and interference with privacy. According to Federal Law No. 272 of December 2008, buses, trams, trolleybuses must be equipped with a clearly visible sign warning that cameras are installed here. Without this, videotaping and recording are illegal.
The last violation that occurs when installing video surveillance systems on transport is an incorrectly positioned video re. The place for its installation is the non–working area of the wipers (the upper central or corner part of the windshield), the rest of the space is left free. If the device covers part of the view, the driver may be brought to administrative responsibility. The traffic police inspector has the right to impose a fine, but in practice it often ends with a warning with the requirement to eliminate the violation.
Features of the implementation of video surveillance systems in transport
The technologies allow not only to capture what is happening in the area of the cameras, but also to record or/and transmit information through a cloud service. The practical implementation of the video surveillance project will require one or more video cameras, a recorder, 3G WiFi, a GPS module for accessing the Internet, a special hard drive operating in moving vehicles, a cable for connecting equipment into a single system.
The technical side requires specific solutions. Universal or amateur video surveillance systems are not suitable for installation on vehicles. - The camera mounts must withstand extreme shock and vibration loads.
- The equipment in the system should be selected not only according to the conformity of certification, but also compatible in terms of technical characteristics.
- The dimensions of the camera, their design, vandal-proof execution matter.
- Due to the fact that the moving parts of the devices are subjected to constant mechanical overloads, the maintainability of video surveillance systems and the ease of installation of individual components are important.
